Just been trying to register my group name on myspace, and someone already has the name.. it look like they havnt had it for as long as the live act i run.

They are based in the states and are a punk band.. does anyone know what kind of recourse i have in getting them to stop using the name?

Is it even important? Am i being picky?

I dont want to change names as i like it.

well, i know that in cases where several artists have the same name, and the UK act puts out music later, the uk act gets a "uk" stuck on theirs when sold in the US, i.e. The Chameleons UK. i think this is only an issue if you are publishing and/or releasing records in the US though, and otherwise i don't think you have any legal recourse, though i could be wrong...

...tocsin would probably know.

yep you cant really do anything about it mate, it would be a different case if it were a major act and there were genuine conflicts of interest, for example if someone started putting out music under the name Robbie Williams, they wouldnt have to wait long before his management where on the phone, obviously Robbie Williams will have his name branded and protected in some way shape or form as its a multimillion pound revenue at stake and what not, doesnt mean a thing in the small world of techno though unfortunately

i remember the band The Electric Soft Parade had similiar problems when they were called The Soft Parade as an american group had the same name so they thrashed out a deal where they would add the "Electric" to their name, but like i said thats major label stuff where genuine confusion, loss of earnings, artistic compromise etc etc plays a big factor

usually boils down to money, and who has the potential to make the most, or is currently making the most, for their respective labels

Hey guess what? The same freaking thing just happened to me. There is a drum and bass dj from the UK with the exact same name as me. LOL

I mailed him but i have no clue what to do otherwise. Do a search for DJ Pauze on myspace and you will see him. I'm not sure really what to do mate.

I know "Plasticman" has had to change his name recently, after legal pressure from the man Hawtin.

He thought it was well funny, he'd never heard of Plastikman before.

He's calling himself "The Plastician" now.

There`s a big difference between european and US law.
You can talk to my mate, who is a qaulified expert in these matters if you like, but I`m pretty sure that essentially your stuffed.
However, it shouldn`t matter too much.

At the bar I used to work at we had Dave Clarke behind the decks every Saturday night - except it was 'Dave Clarke (Galaxy 106)'. Shame really, would have enjoyed being there otherwise ;)

It tends to come down to who's got the most money, but also who can show they have used it first doesn't it.

Mind a US punk band and a UK techno act, there's less likely to be issues I'd guess....

Same happend to me, I went to do a myspace page and there was allready a Casual violence page for some band, weird as **** thing is they live in my town.
They look about 12 yrs old and had a pink page lol.........TWATS

as to the original post, i have dont some research here in the states and what i have found is.

1. you have priority if you ahve played a city before another with the same name. who plays it first gets to use thier name there.

2. you can get a service mark, meaning you and only you can use the name in the US. this cost around $300 US for three or five years.

3. in the industry using a name that sounds like the name you use is not allowed. an example synnister, sinnister. phonetically the same = no no.

after that, it is all about writing them with a nice statement and putting the pressure, quote the law, then ask for a cease and desist....if it works great, if not then not much you can do, but most people will do it if it looks like you have beat them to the punch and know way more than they do.

basic US law...just act like you know more and bluff your way to get what you want. (or something along those lines.)

You're right Mark. From what most users I know say to me, it's that they waste far too much time on it. I know it has its advantages and stuff but I honestly think that's overshadowed by the time it wastes. Depends on the user I guess. Personally I'm not planning on getting a Myspace anytime soon, I waste enough time on BOA as it is :)

It`s about the same as any other form of internet networking, and promotion , forums etc
It is what you let it to be, don`t take it too seriously.
Personally I`ve found it quite handy.
It takes up hardly any of my time at all.
